LIGC (Oxford Earth Academy) Terms & Conditions

1. Definitions

a. “Oxford Earth Academy” is a trading name of LIGC Ltd.

b. “LIGC” is Leadership in Global Change Ltd, registered in England (no. 10076144) and based in Oxford, UK.

c. “Student” means the Student attending an LIGC Course.

d. “Course” means all content, accommodation, food, logistics and staff involved in the delivering a course or event run by LIGC either as sole provider or in collaboration with another organisation.

e. “Parent” means either parent or legal guardian of a Student who is under 18.

f. “Applicant” means the person booking and/or paying for the Course.

2. LIGC responsibilities

a. LIGC will use its reasonable care and skill to provide the Student with the Course as described.

b. Where the Student has booked and paid for accommodation, this will be provided for the nights of the Course and the single night between two consecutive Courses where applicable.

c. LIGC operates a strict non-discrimination policy and will make reasonable provisions to enable Students with physical and mental characteristics that require additional support to participate in the Course.

d. LIGC will deal promptly and sensitively with any issues that arise.

e. LIGC will ensure appropriate health and safety and safeguarding precautions are taken to keep the Student safe while taking part in activities organised by LIGC.

f. LIGC will engage third party services with due care and attention to ensure quality and safety.

g. LIGC will treat any personal date provided in accordance with relevant legislation and its own Privacy Policy.

3. Parent and Student responsibilities

a. The Applicant warrants that they can enter into an agreement for the Student to attend an LIGC Course.

b. The Applicant warrants that the student will be the age specified for the particular Course in which they are enrolled, unless LIGC has agreed to take a younger or older student.

c. The Applicant agrees to pay any additional expenses incurred by LIGC on behalf of the Student including medical fees and the cost of rectifying any loss of damage caused by the Student.

d. The Parent warrants that the Student will behave in an age appropriate, and as far as is reasonable to expect from a student of the relevant age, in a respectful, responsible and legal manner while attending the Course.

e. The Parent is responsible for ensuring that the Student is self-insured or covered by insurance cover for contents, mental and dental work, travel, and cancellation.

f. The Parent is responsible for ensuring that the Student is in possession of the appropriate visas and travel arrangements in time for arriving on the Course.

g. The Parent gives their consent for the Students who are 15 years and older to be unsupervised by LIGC staff for portions of the day in which free time is scheduled.

h. The Parent gives their consent for the Student to engage in supervised activities.

i. The Parent and Student gives consent for the Student to receive necessary emergency medical treatment on the advise of a qualified medical practitioner.

j. The Applicant gives consent for LIGC to purchase private medical attention and treatment if LIGC staff deem it to be necessary, and NHS services are not available.

k. The Parent and Student agree to provide on application, all necessary information on any additional physical or mental support that the Student will or may need during the Course.

l. The Parent is responsible for satisfying themselves about the suitability of the Course for the Student.

m LIGC is not responsible for taking care of the Student’s belongings during the Course.

n. The Parent gives permission for LIGC to take, keep and use photos of the Student for identification and security, and for marketing purposes, IF the Student also agrees.

o. The Parent is responsible for all travel costs, costs associated with loss or damage of possessions, costs incurred due to travel delays or cancellation, costs incurred in the event that LIGC cancels the Course.

p. The Student and Parents must arrange for the Student to arrive and depart at the times specified for the Course on which they are enrolled.

4. Liabilities

a. The Parent and Student indemnify and hold harmless LIGC, its agents, staff, officers and representatives against any failure by the Parent or Student to comply with these conditions and any rules reasonably imposed by LIGC in connection with the operation of the Course. To the fullest extent permitted by law, the Parent is fully liable for any damage, loss or injury to the person or property, however caused by the Student.

b. LIGC is not liable for any loss or damage for any loss, theft or damage to the Student’s personal property during the Courses.

c. LIGC cannot be held liable for any deficiency in the service beyond its control or what could have reasonably been identified prior to the delivery of the service.

d. The maximum liability of LIGC to the Applicant, Parent or Student shall be the equivalent to the amount of fees paid for the Course attended by the Student.

5. Booking and cancellation

a. Unless other arrangements are in place, full fees are due on booking.

b. The Applicant has 14 days from the date of booking to cancel their booking.

c. The Applicant may cancel the place up to four weeks before the start of the Course.

d. In the event of cancellation, a 10% fee will be retained to cover the costs incurred by LIGC in booking accommodation for the student.

e. LIGC reserves the right to cancel a Course up to six weeks before the start of each Course week. In the event of cancellation, LIGC will refund Course fees in full but will not be liable for travel costs incurred.

f. LIGC reserves the right to cancel a Course due to Covid-19 restrictions up to two weeks before the start of each Course week. In the event of cancellation due to Covid-19 restrictions, LIGC will refund Course fees in full but will not be liable for travel costs incurred.

6. Force Majeure

a. LIGC will not be responsible to the Applicant, Parent or Student or other person or organisation in the event of any change in the Course due to circumstances beyond the reasonable control of LIGC.

7. General

a. The Parties to this contract are LIGC, Parent and Applicant (where the Parent is not the Applicant), and the Student to the extent allowable in Law.

b. This agreement represents the entire agreement and understanding between LIGC and the Applicant, Parent and Student and supersedes and previous agreement relating to the subject matter of this agreement.

c. No term of this agreement shall be enforceable by a third party.

d. This agreement shall be governed and construed in accordance with the law of England and Wales.
